Privacy Policy

1. Who We Are And What This Policy Covers

Bangin’ at The Barn LLC, doing business as Bangin’ at The Barn (“The Barn,” “we,” “us,” or “our”), respects your privacy. This policy explains how we collect, use, disclose, retain, and protect personal information in connection with our text message program, related email marketing, signup forms, and connected customer interactions on banginatthebarn.com.

Our text message program may include SMS and MMS messages about sporting goods, new products, special offers, apparel, team and fan stores, lessons, leagues, training opportunities, and other Barn news. The messages you receive depend on the program you join and the permission you provide.

This policy addresses our messaging and related marketing activities. Other notices may apply to purchases, registrations, or services outside this scope. Third-party websites and services have their own privacy notices. Reading this policy, visiting our website, making a purchase, or providing a telephone number for another purpose does not, by itself, enroll you in marketing texts.

2. Information We Collect

Depending on how you interact with us and the features we use, we may collect:

  • Contact information: your name, mobile telephone number, email address, and information you voluntarily provide through signup forms or customer communications.
  • Subscription and consent information: whether you subscribe to SMS or email, when and how you subscribed, the signup source, consent disclosures associated with your enrollment, confirmation records, and unsubscribe requests. Where available, these records may include an IP address, form details, or other evidence of consent.
  • Message activity: messages sent to you, delivery status, timestamps, link clicks, replies supported by the messaging service, help requests, and opt-out activity.
  • Customer interests and connected purchase information: product preferences, interests you tell us about, and order or registration information available through a connected store or customer system, such as products purchased, purchase dates, or participation in Barn programs.
  • Technical information: IP address, browser and device information, referring pages, and interactions with signup forms or linked website pages, to the extent collected by the tools used for those interactions.

Please do not send payment card numbers, passwords, Social Security numbers, medical information, or other sensitive personal information in text messages or marketing signup forms.

3. How We Receive Your Information

We collect information directly from you when you complete a signup form, choose to receive texts, contact us, respond to a supported message, or provide preferences. We may also receive relevant information from our website, connected ecommerce or registration systems, and service providers that help us operate our messaging program.

We do not treat a phone number on an order, a lesson registration, a team roster, or an email subscription as permission to send marketing texts. SMS enrollment requires separate consent. A coach, team representative, or other customer cannot enroll another person merely by giving us that person’s number.

4. How We Use Information

We use information for the following purposes, as relevant to your interactions and permissions:

  • Maintain subscriber lists and record consent, preferences, and opt-outs.
  • Send the promotional messages you have requested, including recurring or automated messages where disclosed at signup.
  • Provide relevant product announcements, offers, store updates, and information about our programs.
  • Personalize communications using your stated interests or connected customer activity.
  • Respond to questions and support requests, where the platform supports replies.
  • Measure delivery, clicks, subscriptions, and campaign performance so we can improve our communications.
  • Diagnose delivery problems, prevent abuse or fraud, maintain security, and enforce program rules.
  • Meet legal obligations, maintain necessary records, and honor requests not to receive marketing.

We use your information to communicate on behalf of The Barn. We do not use SMS enrollment as permission for unrelated businesses to market to you.

5. How Mailchimp Processes Information

We use Mailchimp, an Intuit service, to help manage subscribers and deliver marketing communications. Information provided to or processed through Mailchimp may include your contact details, subscription status, consent records, audience preferences, message activity, and connected customer information described above.

Mailchimp and its supporting service providers process information to host subscriber records, send and route messages, manage confirmations and opt-outs, monitor delivery, provide reporting, maintain security, and support the service. Telecommunications providers and mobile carriers also process the information needed to transmit messages to your device.

Your information may be stored or processed in the United States and other locations where our providers operate. Privacy protections and legal requirements may differ between locations. Where applicable, transfers are subject to legally required safeguards.

For information about Mailchimp’s practices, visit https://mailchimp.com/legal/privacy/ and follow the current privacy statement linked there. This policy describes The Barn’s practices; Mailchimp’s privacy notices describe its own processing activities.

6. Mobile Information And SMS Consent Are Not Sold Or Shared For Others’ Marketing

We do not sell, rent, or share mobile telephone numbers, SMS subscriber information, or SMS opt-in data and consent with third parties or affiliates for their own marketing or promotional purposes.

We disclose SMS information only as needed to service providers supporting our program, such as Mailchimp, messaging platforms, delivery providers, and telecommunications carriers; to comply with law or valid legal process; or to protect legal rights and security. Service providers receive information to perform their services, not to use your SMS consent to market their own products to you.

Any broader disclosure language elsewhere in this policy is subject to this restriction. SMS consent is specific to The Barn and does not authorize marketing messages from another business.

7. Other Limited Disclosures

Within the scope of this policy, we may disclose relevant information:

  • To authorized staff and contractors who need it to manage communications, provide support, or maintain systems.
  • To hosting, ecommerce, technical support, security, and other providers that support the customer interactions described in this policy.
  • To authorities or other parties when required by applicable law, a court order, or valid legal process, or when reasonably necessary to address fraud, security threats, or legal claims.
  • In connection with a merger, acquisition, or transfer of business assets, subject to applicable law and the SMS restrictions above. A business transaction does not itself expand your marketing consent or authorize unrelated marketing.
  • At your specific direction or with permission where required, subject to the SMS restrictions above.

8. SMS Consent And Program Expectations

We obtain the consent required for marketing texts before sending them. Where required, this includes express written consent to recurring automated promotional messages. Consent is voluntary and is not a condition of buying goods or services from The Barn.

Email marketing consent and SMS marketing consent are separate. Joining one does not automatically subscribe you to the other. Publishing or updating this privacy policy does not create consent.

Message frequency varies based on the program, promotions, and your interactions. Any frequency stated in the signup disclosure or SMS terms applies to that program. Message and data rates may apply under your mobile plan. Delivery depends on your mobile carrier and service availability.

Please provide a mobile number you own or are authorized to use, and notify us if that number changes or is reassigned.

9. How To Stop Texts Or Request Help

Reply STOP to a marketing text from The Barn to unsubscribe from that SMS program. You may receive a final non-promotional message confirming your unsubscribe request. We will honor other clear requests to stop as required by applicable law. You may also contact us using the details below.

Reply HELP for program assistance, or contact us directly. If a messaging channel does not support replies, use the unsubscribe method provided in the message or contact us.

Unsubscribing from texts does not automatically unsubscribe you from email. To stop marketing emails, use the unsubscribe link in an email or contact us. Changing marketing preferences does not prevent communications independently permitted or required by law concerning an existing transaction or service.

10. Cookies, Link Tracking, And Connected Activity

Our signup forms, marketing emails, and linked website pages may use cookies, tracking pixels, tagged links, or similar technologies, depending on the tools and settings in use. These tools can help operate forms, remember preferences, measure email or link engagement, and connect campaign activity with website visits or purchases.

You can manage cookies through your browser and any privacy controls available on the website. Blocking cookies may affect some functionality. To stop SMS marketing, use the opt-out methods above; browser settings alone do not unsubscribe you.

We will describe any additional tracking-based SMS features, including abandoned-cart reminders, before using those features and obtain any additional consent required. This policy alone does not enroll you in abandoned-cart texts.

11. How Long We Keep Information

We retain personal information for as long as reasonably necessary for the purposes described in this policy, including operating subscriptions, providing support, maintaining consent evidence, complying with legal obligations, and resolving disputes. Retention depends on the type of information, the purpose for collecting it, applicable requirements, and legitimate recordkeeping needs.

After you unsubscribe, we may retain limited records, such as your number, opt-out status, and consent history, to honor your request and document compliance. Unsubscribing does not necessarily delete all prior records. Information no longer needed is deleted or de-identified in accordance with applicable requirements and available system processes. Backup copies may remain until replaced or deleted through ordinary retention cycles.

12. How We Protect Information

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, and limit access according to business needs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Text messages may appear on a device’s lock screen or be accessible to someone with access to the device or mobile account. Please consider this when sharing a phone or deciding what information to send us.

13. Your Privacy Choices And Requests

You may contact us to request access to, correction of, or deletion of personal information associated with our messaging program, or to update your preferences. Depending on where you live and whether applicable privacy laws cover our business, you may have additional rights, such as obtaining a copy of information, appealing a decision, or using an authorized agent.

We will handle requests as required by applicable law. We may need to verify your identity before disclosing, changing, or deleting information. Some records may be retained where legally required or reasonably necessary for permitted purposes, including maintaining an opt-out record. We will not discriminate against you for exercising rights protected by applicable privacy law.

Please do not send identity documents or sensitive information unless we request them through an appropriate method. For a simple SMS unsubscribe request, replying STOP is the most direct option.

14. Children And Youth Programs

Our marketing signup forms and SMS program are directed to adults, including parents and guardians purchasing products or arranging youth activities. We do not knowingly collect personal information through these marketing channels from children under 13. Parents and guardians should use their own contact information for marketing subscriptions associated with youth activities.

If you believe a child under 13 has submitted information through our marketing program, contact us so we can investigate and take appropriate action. Information needed to administer youth registrations or activities may be addressed in separate registration notices; participation does not automatically enroll a child or parent in marketing texts.

15. Third-Party Links

Our communications may link to product pages, team stores, registration platforms, social media, or other third-party services. Those services may collect information under their own privacy policies. Review their notices before providing information.

16. Changes To This Policy

We may update this policy as our practices, services, or legal requirements change. We will update the effective date when we publish a revised policy and provide additional notice or request new consent where required. A policy change does not override an unsubscribe request or expand SMS consent beyond what applicable law permits.
